Terms and Conditions – Industry Training Works (ITW)
By registering for, purchasing, or attending any course or service with Industry Training Works (ITW), you agree to the following Terms and Conditions.
ITW reserves the right to update these Terms and Conditions and associated products or services at any time.
Changes to Terms and Conditions
We may update these Terms and Conditions from time to time. Where updates occur, the revision date will be amended accordingly.
Cancellations and Rescheduling
All cancellations or rescheduling requests must be submitted in writing to itw@itw.org.nz
Cancellation fees (based on full course cost) apply as follows:
- 3–5 business days’ notice: 50% fee
- 2 business days or less: 100% fee
Industry Training Works Ltd will not be liable for any costs incurred by the Customer due to cancellation arising from circumstances beyond our control including but not limited to trainer illness.
Online Training
- Cancellations must be requested in writing and are only valid if the login has not been activated.
- Logins expire 3 months from date of issue.
- No refunds are provided for expired or unused logins.
Failure to Attend
Failure to attend a booked course will be recorded as a “No Show”, and the full course fee will apply.
Course Scheduling
The availability of courses and dates published on the website and schedule are subject to change without notice.
ITW reserves the right to:
- Cancel or alter the dates of any ‘open’ courses due to insufficient numbers of participants.
- Suspend training where continuing would breach the Health and Safety at Work Act 2015 or pose unacceptable risk
- Refuse attendance to any individual deemed unfit (e.g. due to health, intoxication, or behaviour)
- Decline training where a conflict of interest or competitive concern exists
Course duration may vary depending on group size and participant experience.
Late Arrival
- Within 30 minutes: Attendance at trainer’s discretion
- More than 30 minutes: Attendance not permitted
Additional costs may apply if a student is required to return to complete training.
Disciplinary action
Industry Training Works Ltd reserves the right to remove a participant from training should disruptive behaviour be deemed to be detrimental to the learning outcome. A resolution will be sought between trainer, participant and their manager. Should a satisfactory resolution not be achieved, the participant will not be reinstated, and no refund will be given.
Safety Gear and PPE
All participants must comply with ITW’s PPE requirements, including (but not limited to) safety footwear and hard hats.
Failure to comply may result in removal from the course. Any reattendance costs may be charged.
Entry Requirements
Participants must meet minimum English language requirements (e.g. NCEA Level 1 or equivalent / IELTS 5.5).
If this requirement is not met, a reader/writer must be provided (not another course participant).
Special Requirements
You must advise ITW of any special requirements (e.g. health, literacy, cultural) prior to training.
Payment Terms
- On Account: Payment must be made within agreed terms
- Pre-payment: Payment is required prior to course commencement
The Customer agrees to pay interest of 5% per month on all overdue amounts.
The Customer agrees to pay Industry Training Works Ltd all agency collection fees associated with the collection of an unpaid debt.
Pricing and Additional Fees
Prices are subject to change unless otherwise agreed.
Additional fees may include:
- Travel and accommodation (where required)
- Issuing ‘Urgent Competency Reports’ will incur an administration fee of $20.00+GST per report and requires payment before the request can be completed.
All additional costs will be advised during booking.
NZQA Reporting
As a New Zealand Qualifications Authority-registered Private Training Establishment, ITW reports credits within 3 weeks of course completion, where competency is achieved.
Competency/Reassessment
It is Industry Training Works Ltd intention to mark a course participant as Achieved “A” or Not Achieved “NA” upon completion of the course. A participant who is marked as “A” will receive their Certification, Electronic Certificate or equivalent within 3 weeks of completing the course. A Student who is marked as NA cannot have the unit standard accredited to them and will not receive any certification. The Customer will be advised if a Student is marked NA. A plan will be developed with the Customer to ensure that the Student has all opportunities available to achieve competency status on a case by case basis. Students have the right to re-assessment for any course where they did not receive competency. If students wish to re-sit assessments, they will need to contact ITW customer services who will assist with the arrangements.
Pre- and Post-Course Requirements
You are responsible for completing all required documentation and providing evidence where required.
Failure to do so may impact course completion or certification.
Attestation Forms
Where required, attestation forms must be returned within the specified timeframe. Failure to do so may delay or prevent credit reporting.
Communication
By engaging with ITW, you may receive occasional updates or promotional communications. You can unsubscribe at any time.
We will not share your information with third parties unless required by law.
Training Records
By attending training with ITW, you consent to your training records being shared with your employer or the booking contact where applicable.
Treaty of Waitangi / Te Tiriti O Waitangi
Industry Training Works recognises the Treaty of Waitangi as the founding document of New Zealand and seeks to apply the principles of the Treaty in our day to day activities.
Te Reo Assessment
Students may request to be assessed in Te Reo Maori. As this is likely to involve engaging a suitably qualified third party to carry out the assessment or translate written submissions, a request must be submitted to the customer services team in writing 14 days prior to the assessment taking place. On receiving such a request, the customer services team will immediately forward the request to the Company Moderator and make arrangements for carrying out the assessment.
