TERMS AND CONDITIONS
Industry Training Works Ltd (ITW) is a NZQA registered and accredited health and safety training company. These terms and conditions act as an agreement between Industry Training Works, Course registrant or Customer.
In these Terms and Conditions:
‘Service’, ‘Services’ means any service that is provided by Industry Training Works Ltd including but not limited to training courses;
‘We’ and ‘Us’ and ‘Our’ means Industry Training Works Ltd.
‘You’ and ‘Your’ means a Customer;
‘Website’ means the Industry Training Works Ltd website at URL itw.org.nz
‘Product’ means any product or Service offered by Industry Training Works Ltd;
‘Customer’, ‘Customers’ includes any person buying or registering for a service from Industry Training Works Ltd
Changes to Terms and Conditions
We reserve the right to update these Terms and Conditions from time to time and if we do so we will advise our customers through email and our website itw.org.nz that the Terms and Conditions have been updated
Cancellations
Cancellation of training courses or booked Services must be made in writing to itw@itw.org.nz Cancellation fees are based on full course costs and will be incurred on the following basis:
– Where you have given notification to Industry Training Works Ltd at least 10 working days’ prior to scheduled training or booking there is no cancellation fee.
– Where you have given notification to Industry Training Works Ltd within 3-9 working days’ prior to scheduled training or booking there is a 50% cancellation fee.
– Where you have given notification to Industry Training Works Ltd less than 72 hours prior to scheduled training or booking there is a 100% cancellation fee.
Industry Training Works Ltd will not be liable for any costs incurred by the Customer due to cancellation arising from circumstances beyond our control including but not limited to Trainer illness.
Online and Self-Managed Learning
These programmes are exclusively designed to enable a trainee to complete their learning at their own pace. An experienced and expert trainer is allocated to them to provide assistance when and if required. They will help the trainee gain the skills and knowledge they need to succeed.
All the training material and instructions are sent to the trainee via email or post. Once completed, the material can then be scanned and emailed to itw@itw.org.nz or sent by Courier to ITW P O Box 656, Tokoroa 3444. Upon receipt, the Trainer will then mark the material and award competency based on their submission and will provide feedback to the trainee.

Failure to attend training
Failure to attend a course will result in a ’No Show’ attendance status. All ‘No Shows’ will be charged the full course cost.
Course/Training Schedule
The availability of courses and dates published on the Website and schedule are subject to change without notice.
We reserve the right to cancel or alter the dates of any ‘open’ courses due to insufficient numbers of participants.
We reserve the right to suspend training where to continue would breach the Health and Safety at Work Act 2015 (“HSWA”), or where continuing might place participants at an unacceptable level of risk.
We reserve the right to refuse to train any person who is deemed by us to be unfit due to health reasons including but not limited to intoxication, drug use or behavioural issues.
We reserve the right to refuse to train any company, employee or individual who we reasonably believe may be in direct competition with Industry Training Works Ltd.
Course duration may vary based on number of Students attending and level of knowledge and/or experience.
Late Student Arrival
Within 30 minutes of scheduled start time: Student may remain on course only at the trainer’s discretion.
Over 30 minutes of scheduled start time: Student may not attend the course.
Should it be necessary for the student to return to complete the course at a later date due to late arrival issues, Industry Training Works reserves the right to pass on any associated costs to the student or their employer.
Company Specific Courses
If training is held at the Customer’s premises the Customer agrees to provide all facilities including; training room, air-conditioning/heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/white wall, and tea/coffee facilities. Facilities for specific courses are as specified in the confirmation email and are according to the course requirements. Please note a venue pre-check may need to be completed to ensure suitability, if an alternative venue is required, cost will be the responsibility of the customer.
Health and Safety site requirement: it is the customers responsibility to make available to Industry Training Works Ltd, at point of booking the Health and Safety policies and/or any standard operating procedures (SOPs) that may impact any training provided on your site.
Safety Gear and Personal Protective Equipment (“PPE”)
In accordance with the HSWA, all students are required to comply with any instruction, policy or procedure issued by Industry Training Works Ltd in relation to the use of PPE. This includes, but is not limited to, the wearing of hard hats, hi vis and safety footwear. Failure to comply may result in a student being removed from the course in the interest of safety.
Should it be necessary for the student to return to complete the course at a later date, Industry Training Works reserves the right to pass on any associated costs to the student or their employer.
Disciplinary action
Industry Training Works Ltd reserves the right to remove a participant from training should disruptive behaviour be deemed to be detrimental to the learning outcome. A resolution will be sought between trainer, participant and their manager. Should a satisfactory resolution not be achieved, the participant will not be reinstated and no refund will be given.
Entry Standards
All Students must have a level of written and oral English equivalent to NCEA level 1 (year 11) or IELTS 5.5 or higher, to be eligible to enrol on courses. Student and the person responsible for making bookings or authorising attendance at the course must agree to and sign these Terms and Conditions prior to acceptance of their student(s) onto the course. Where a Student does not meet our English language requirement a reader/writer must be supplied by the Student or the person responsible for authorising the student’s attendance. The reader/writer cannot be another student attending the same course.
Special Requirements: Industry Training Works Ltd must be advised at time of booking if any student has any special requirements, including but not limited to health, literacy and cultural requirements.
Payment Terms
‘On Account’ – The Customer agrees to make full payment for Services in accordance with approved payment terms.
‘On Pre-payment’: On confirmation of booking, an invoice will be emailed to you. Payment of this invoice in full must be received by Industry Training Works Ltd prior to attending the course. Credit card payments can be made via our website.
The Customer agrees to pay interest of 5% per month on all overdue amounts.
The Customer agrees to pay Industry Training Works Ltd all agency collection fees associated with the collection of an unpaid debt.
Prices and Additional Fees.
The prices published on the Website are subject to change without notice unless you have an agreement with us stating otherwise.
Issuing ‘Urgent Competency Reports’ will incur an administration fee of $35.00+GST per report and requires payment before the request can be completed.
The Customer agrees to pay any additional costs incurred by Industry Training Works Ltd, such as travel and accommodation when local resource is unavailable. These charges will be charged at cost to the Customer and will be advised during the booking process.
NZQA Framework Registration.
As an NZQA accredited Private Training Establishment (PTE) we upload credits to the NZQA Framework within 3 weeks following course completion based on awarded competency. Additional charges will apply per extra unit/credit added at the time of booking.
Student Progress / Requirement for Completion.
Learning objectives are detailed at the beginning of each training module and assessment is conducted throughout the course. A practical assessment may also be conducted in some programmes. Students will be required to achieve the required level of competency in all areas of the assessment to be awarded the unit standard(s) and credits. Assessment is conducted in compliance with competency based assessment according to NZQA criteria.
Competency/Reassessment
It is Industry Training Works Ltd intention to mark a course participant as Achieved “A” or Not Achieved “NA” upon completion of the course. A participant who is marked as “A” will receive their Certification, Electronic Certificate or equivalent within 3 weeks of completing the course. A Student who is marked as NA cannot have the unit standard accredited to them and will not receive any certification. The Customer will be advised if a Student is marked NA. A plan will be developed with the Customer to ensure that the Student has all opportunities available to achieve competency status on a case by case basis. Students have the right to re-assessment for any course where they did not receive competency. If students wish to re-sit assessments, they will need to contact ITW customer services who will assist with the arrangements.
Pre-Course / Post-Course Requirements
The Customer accepts full responsibility for failure to abide by any pre-course or post-course requirements. This includes, but is not limited to, completing and returning course paperwork, evidence of competency, attestation forms.
Attestation Forms
Where an Attestation Form is required, the student will have a time-frame given from the date of the course to complete and return the form to Industry Training Works. Failure to return a completed Attestation Form before due date, may prevent the unit standard being processed as competent.
Funded Courses
Industry Training Works Ltd accepts no responsibility for the withdrawal of any funding or subsidies. In the event that funding or subsidies are withdrawn, or the Customer is found not to be eligible for the funding or subsidy, Industry Training Works Ltd will invoice the Customer the full course cost and the Customer remains liable for that amount.
Communication
You may occasionally receive e-newsletters and promotional emails from Industry Training Works Ltd once the booking form has been returned. You can unsubscribe by following a link in any of the emails you receive. Industry Training Works Ltd will not pass your email on to any 3rd party unless required to do so by law.
Privacy Act
Industry Training Works collects and stores information to comply with the requirements of the Tertiary Education Commission (funding and student statistical returns), New Zealand Qualifications Authority (Record of Learning and Unit Standard outcomes), employers (academic outcomes) and Industry Training Organisations (funding and academic outcomes). The information is also used to select students for qualifications, to manage internal administrative processes, and for internal reporting. Information about students may be supplied to, and sought from, other educational institutions for the purpose of verifying academic records. In addition, when required by statute Industry Training Works leases information to Government agencies such as the New Zealand Police, Department of Justice, Department of Work and Income, and the Accident Rehabilitation Compensation Corporation (ACC), NZ Immigration Service.
Treaty of Waitangi / Te Tiriti O Waitangi
Industry Training Works recognises the Treaty of Waitangi as the founding document of New Zealand and seeks to apply the principles of the Treaty in our day to day activities.
Te Reo Assessment
Students may request to be assessed in Te Reo Maori. As this is likely to involve engaging a suitably qualified third party to carry out the assessment or translate written submissions, a request must be submitted to the customer services team in writing 14 days prior to the assessment taking place. On receiving such a request, the customer services team will immediately forward the request to the Company Moderator and make arrangements for carrying out the assessment.
